Fusion Festival Photography and Poetry Competition Terms and Conditions
By entering the Fusion Festival Photography and Poetry Competition conducted by Southern Cross University Lismore NSW 2480 ABN: 41 995 651 524 | CRICOS Provider: 01241G, you agree to the following terms and conditions:
1. Who can enter
1.1 Entry is free and open to Southern Cross University staff and students, TAFE and Senior College staff and students of the Coffs Harbour Education Campus.
1.2 If under 18 years of age, you have your parent's or legal guardian's consent to enter the competition.
2. How to enter
2.1 Entrants must submit their photograph or poem by midnight, Sunday 20 August 2017 by completing the Fusion Festival Photography and Poetry Competition Online Form.
2.2 By completing the application form you have certified that any individual who appears in the photograph has given you permission to take the photograph and to submit the photograph in this competition, knowing that the photograph may be published by the University including on the World Wide Web.
3. The competition
3.1 Information on how to enter outlines part of these Terms and Conditions. Participation in the competition is deemed acceptance of these Terms and Conditions.
3.2 All entries must be original to and created solely by the person entering the competition. The photograph or poem must not contain any material that infringes the rights of anyone else.
3.3 All entries must encompass the Fusion Festival theme: "Colours of Humanity"
3.4 Photography entries must be accompanied by a description of 25 words or less.
3.5 Photography files must be in .jpg format (no more than 1-2MB in size). Poetry entries must be a Microsoft Word document (.doc or .docx.) and the maximum allowed file size is 1-2MB.
3.6 Entries are restricted to one (1) online entry form per person.
3.7 The prize winners will be selected by a panel of judges determined by Southern Cross University. The prize winners will be notified via the email and/or telephone details provided in their online entry form.
3.8 Following notification by email and/or telephone, prize winners will be publicly announced on Monday 5 September at the Opening of the Fusion Festival and may also be posted on the Library's Facebook page.
3.9 An array of entries may be displayed on Flickr, University print publications, public displays and on the World Wide Web, Facebook and Twitter.
3.10 Entrants may be contacted by SCU unless SCU is notified otherwise.
3.11 In the event any winner is under the age of 18 years, the prize may be awarded to the winner's parent or legal guardian.
3.12 The prize winners are final (unless unclaimed) and no correspondence will be entered into.
3.13 SCU reserves the right to select an alternative winner in the event the winner is unable to satisfy these terms and conditions, forfeits or does not claim a prize.
3.14 The prizes are not redeemable by the winners for cash or alternative prizes.
3.15 SCU reserves the right to substitute a prize for another prize of equal value in the event that the prize is not available.
4. Limitation of liability
4.1 SCU reserves the right in its sole discretion to cancel, terminate, modify or suspend the competition subject to any written directions under applicable legislation in the event this competition is not able to be conducted as planned, due to infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the control of SCU which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition. SCU also reserves the right to disqualify any individual who SCU has reason to believe has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition.
4.2 SCU accepts no responsibility and shall not be held legally liable or responsible for any accident, loss, injury or damage to any individual or property whether direct or indirect, whether in contract, tort or negligence or otherwise arising out of or in connection with the competition or the prize either during or after the competition.
5.1 Personal information provided by an entrant to SCU for the purpose of entering the competition will be collected, used and disclosed in accordance with SCU's Privacy Management Plan. A copy of the Privacy Management Plan is available at scu.edu.au/privacy. Personal information collected will be kept strictly confidential and will not be sold, reused, rented, loaned or otherwise disclosed to a third party otherwise than in accordance with the Privacy Management Plan and these terms and conditions.
6. Use of entries by SCU
6.1 Each entrant retains copyright of their photograph and/or poem but grants SCU the right to reproduce, publish, transmit or otherwise communicate to the public their entry, in whole or in part, in or using any media for any purpose without permission or payment. This may include University print publications, public displays and on the World Wide Web, Facebook and Twitter.
6.2 Each entrant represents and agrees that all elements contained in the competition entry or other material:
6.2.1 are original to the entrant/s and available for use as contemplated by this clause;
6.2.2 does and will not, in any way, violate or breach any of the terms of any other agreement the entrant may be a party to;
6.2.3 does not contain defamatory, tortious, or otherwise unlawful, untrue or inaccurate information, infringe or violate any copyright or other right, or contain any matter the publication or sale of which will violate any federal or state legislation or regulation.
