Unit description

Provides a basic understanding of the principles upon which liability to pay compensation is based through detailed study of a number of tort actions including negligence, trespass, nuisance and defamation. Evaluate examples of the various forms of conduct and states of mind which can give rise to liability, and the different consequences which may be compensated. Critically examine the effectiveness of the law of torts in achieving its principal objective of deterrence, resource allocation, compensation and loss distribution.

Module 1: Introduction and Trespass to Persons and Land
Module 2: Nuisance, Interference with Goods, Defamation
Module 3: Negligence; Duty (generally) & Breach
Module 4: Negligence; Causation and Damage
Module 5: Negligence; Particular Duty situations
Module 6: Negligence; Defences and Loss Distribution

Learning outcomes

Unit Learning Outcomes express learning achievement in terms of what a student should know, understand and be able to do on completion of a unit. On completion of this unit, students should be able to:

2identify legal issues and apply legal reasoning to develop justifiable responses to torts law problems
3research and construct a sustained and persuasive legal argument
4communicate effectively both orally and in writing for legal audience.

On completion of this unit, students should be able to:
