Unit description

Introduces students to the legal system of Papua New Guinea as well as aspects of business law. The unit focuses on the law of contract and also considers negligence, consumer protection and agency, with an emphasis on legal problem-solving. The connection between law and ethics and the role of ethics in business are also explored.

Unit content

Module 1: The Papua New Guinean Legal System and Introduction to Negligence

Module 2: Making a Contract — Intention, Agreement and Consideration

Module 3: Making a Contract — Capacity, Genuine Consent, Legality and Form

Module 4: Construction of the Contract

Module 5: Discharge and Breach of Contracts

Module 6: Consumer Protection and the role of agency in the Supply of Goods and Services

Learning outcomes

Unit Learning Outcomes express learning achievement in terms of what a student should know, understand and be able to do on completion of a unit. On completion of this unit, students should be able to:

describe and critically discuss the structure of the Papua New Guinean legal system, and how laws are made and developed, using negligence as an example

demonstrate a basic understanding of legislation and case law relevant to business and commerce, and of the interrelationship between law and ethics

apply the fundamental principles of the laws relating to the creation, construction, and discharge of contracts, to solve contractual problems in business and commerce

apply the fundamental principles of the laws relating to negligence, consumer protection and agency to solve common legal problems encountered in business and commerce.
