Unit description

Introduces students to the legal system of Papua New Guinea as well as aspects of business law. The unit focuses on the law of contract and also considers negligence, consumer protection and agency, with an emphasis on legal problem-solving. The connection between law and ethics and the role of ethics in business are also explored.

3. Making a Contract — Capacity, Genuine Consent, Legality and Form
4. Construction of the Contract
5. Discharge and Breach of Contracts 
6. Consumer Protection in the Supply of Goods and Services
7. Negligence
8. Agency

Learning outcomes

Unit Learning Outcomes express learning achievement in terms of what a student should know, understand and be able to do on completion of a unit. On completion of this unit, students should be able to:
1Describe and critically discuss the structure of the Papua New Guinean legal system and how laws are made and developed
2Apply the fundamental principles of the laws relating to the creation, construction, and discharge of contracts, to solve legal problems in business and commerce.
3Apply the fundamental principles of the laws relating to negligence, consumer protection and agency to solve legal problems in business and commerce .
4Demonstrate basic understanding of legislation and case law relevant to business and commerce, and of the interrelationship between law and ethics.

On completion of this unit, students should be able to:

  1. Describe and critically discuss the structure of the Papua New Guinean legal system and how laws are made and developed
