Unit description

Explores the enforcement of private rights created by civil law. Students analyse the fundamental principles of the law of torts and develop the vocational skills required by paralegals to work in this area of the law.

Unit content

Module 1: The law of torts: meaning and context

Module 2: Intentional torts and private nuisance

Module 3:  Negligence – Duty of care and standard of care

Module 4: Negligence – Causation, defences and vicarious liability

Module 5: Remedies and alternative compensation schemes

Module 6: Contemporary issues in Australian tort law

Learning outcomes

Unit Learning Outcomes express learning achievement in terms of what a student should know, understand and be able to do on completion of a unit. These outcomes are aligned with the graduate attributes. The unit learning outcomes and graduate attributes are also the basis of evaluating prior learning.

On completion of this unit, students should be able to:
1explain the role of tort law and how it has been impacted by legislative change, demonstrate legal writing skills appropriate to the role of a paralegal
2identify the elements of an action for negligence and for certain other torts
3describe the processes by which claims for compensation are pursued and damages are assessed
4apply to factual situations the principles of liability to pay compensation.

On completion of this unit, students should be able to:
